Terms & Conditions

These terms apply to bookings, reservations, events, venue hire and experiences supplied by Kyle Paul Eastham, a sole trader trading as 1910 Bar (“1910 Bar”, “we”, “us”). The trading address is Unit 8โ€“9 Palace Arcade, Bryn Street, Ashton-in-Makerfield, Wigan, WN4 9AU. Email: kyle@1910bar.co.uk.

Please read these terms before booking. By placing and confirming a booking you agree to the terms disclosed for that booking.

1. The booking contract

Your contract for a table, Bottomless Bash, private event, venue hire or other experience is with Kyle Paul Eastham trading as 1910 Bar. The venue is operated as a sole-trader business, not by 1910 Bar Limited. A booking is confirmed when we or our authorised booking platform send a confirmation. Online availability remains subject to confirmation. We may decline or cancel a booking where reasonably necessary, including obvious pricing or availability errors, suspected fraud, or circumstances affecting safe or lawful operation.

2. BeBooked

Where a booking is offered through BeBooked, that platform helps us manage reservations and customer notifications. It may create or provide a customer account and send confirmations, reminders, changes and cancellation notices on our behalf. Keep information you enter accurate and any account credentials secure. BeBooked’s own terms and privacy policy may govern use of its platform or account; these terms govern the services 1910 Bar supplies. A booking made through BeBooked does not make BeBooked the supplier of the venue experience.

3. Your booking information

Provide accurate contact details, date, time and guest numbers, check your confirmation, and promptly tell us about errors. The person booking should tell their party about relevant conditions. Any guest limits will be shown in the booking process or agreed separately.

4. Prices and payment

Bookings made on our website are processed as WooCommerce product orders, but the website does not currently take payment for them. The price and any deposit or advance-payment requirement will be stated when you book or agree a private-hire arrangement. Payment for the booked service is taken at the premises, unless we separately agree another payment method with you. An order or booking confirmation does not mean payment has been taken. Additional purchases at the venue are charged separately. If an obvious pricing error is found before service, you may accept the corrected price or cancel the affected booking for a refund of any amount you have already paid for it.

5. Cancellation and changes by you

Cancel or request changes through BeBooked where available, or contact us directly. Refunds and charges depend on the disclosed booking conditions, notice given and our loss reasonably caused by cancellation. We will take account of costs saved and whether we can fill the booking.

Venue hire

Venue-hire deposits are refundable if you cancel at least 7 days before the scheduled event, unless different terms were expressly agreed when booking. If cancellation is later, we may retain only the amount reasonably necessary to cover loss caused by it; any balance will be returned.

Other bookings

Terms for tables, Bottomless Bash and ticketed events may be stated before purchase. Where no specific term was disclosed, any cancellation charge or retention will reasonably reflect the loss directly caused by cancellation.

6. Statutory cancellation rights

The usual 14-day distance-selling cancellation period generally does not apply to catering or leisure services booked for a specified date or period. A booking for a particular session may therefore have no separate statutory cooling-off period. Any cancellation rights expressly offered to you still apply.

7. Cancellation or changes by us

We may need to change or cancel a booking for operational, staffing, supplier, licensing, legal, safety, emergency or severe-weather reasons. If we cancel and cannot supply the agreed service, you can decline an alternative date and receive a refund for the affected service. We will not exclude liability that cannot lawfully be excluded for other reasonably foreseeable losses.

8. Arrival and no-shows

Please arrive at the confirmed time and contact us if delayed. Arriving late does not extend a timed session. If you arrive so late that we can no longer reasonably accommodate the booking, we may treat it as a late cancellation or no-show, subject to section 5.

9. Bottomless Bash

The session lasts for the duration stated when booking; the website currently describes a two-hour experience. Only the drinks specified for your package are included, and they are supplied during the booked session. Included drinks must not be shared with people outside the package. “Bottomless” does not mean unrestricted alcohol service. Staff may slow, pause or refuse service when reasonably necessary for licensing compliance, responsible service, welfare or safety.

10. Age and identification

Alcohol is sold and supplied only in accordance with licensing law. We may ask for acceptable photographic proof of age and apply an age-verification policy. A person unable to prove age when asked may be refused alcohol service or participation in an alcohol-related experience. False age information or an attempt to obtain alcohol for an underage person may lead to refusal of service or removal.

11. Conduct

Treat staff and guests respectfully. We may refuse entry or service, or require someone to leave, where reasonably necessary because of aggression, harassment, excessive intoxication, unlawful activity, damage, serious disruption, failure to follow reasonable staff instructions, or health, safety or licensing concerns. For serious misconduct, refunds for services already supplied are not normally available; any further retention will reflect reasonably caused loss.

12. Venue hire and decorations

Additional terms expressly agreed for private hire also apply. Unless otherwise agreed, do not use confetti or glitter or attach decorations in a way likely to damage walls. The booking party may be responsible for reasonable repair costs caused deliberately or negligently by them or their guests.

13. Belongings

Look after your belongings. We will take reasonable care of items expressly handed to us for safekeeping. Responsibility for loss or damage depends on whether we failed to exercise reasonable care.

14. Allergies

Tell staff about allergies or dietary needs before ordering or consuming anything. We will provide available allergen information and take reasonable precautions. Do not rely solely on a general product or menu description to manage a serious allergy.

15. Technical problems

BeBooked, the website, payments or messaging systems may occasionally be unavailable. A delay or outage does not automatically cancel a booking already confirmed. Contact us if confirmation is unclear. Problems with third-party technology do not remove our obligations for a service we have confirmed.

16. Booking messages

We and providers acting for us may send messages needed to administer a booking, such as confirmations, changes, reminders, payment notices and cancellations. These are separate from marketing. You need not agree to marketing to book.

17. CCTV and personal information

CCTV operates at the premises for the safety and security of customers, staff and property and to help investigate incidents. Information about CCTV is available in our Privacy Policy and on signs at the venue. This section does not limit your data-protection rights.

Kyle Paul Eastham trading as 1910 Bar is the controller for information used to supply the bar’s services. ICO registration: ZC253111. Booking data may be processed through BeBooked on our behalf where that platform is used; BeBooked may also process information for its own platform purposes under its own privacy policy. Our Privacy Policy explains how to contact us about your data, including CCTV requests.

18. Marketing

We send electronic marketing only where the law permits and provide a way to opt out. Stopping marketing does not prevent necessary booking messages.

19. Responsibility

Nothing limits liability for death or personal injury caused by negligence, fraud, or rights and remedies that cannot lawfully be limited. We are responsible for foreseeable loss caused by a breach of these terms or failure to use reasonable care and skill. Your statutory consumer rights remain intact.

20. Events outside our control

For events outside our reasonable control, such as fire, flood, severe weather, utility outages or government restrictions, we will act reasonably over rescheduling and refunds and apply your legal rights. This clause does not remove a refund entitlement where we cannot supply the contracted service.

21. Third parties

Our website and booking process may link to third-party sites, payment providers and services governed by their own terms. A link alone does not make us responsible for an unrelated website, and it does not remove our responsibility for services we supply.

22. Complaints

Tell staff promptly about a problem, or email kyle@1910bar.co.uk with your booking reference if available.

23. Changes to terms

We may update these terms. The version disclosed when you booked normally applies to that booking unless a legal change is required or you agree otherwise.

24. Severability

If a provision is unenforceable, the remaining provisions continue to apply.

25. Governing law

The law of England and Wales applies. Mandatory consumer protections where you live in the UK and statutory rules about where a dispute can be brought remain unaffected.
